Injunction proceedings in the Netherlands
Dutch injunction proceedings are fast-track civil proceedings for urgent matters. They are used when a party cannot wait for regular proceedings on the merits and needs a quick court decision.
In the Netherlands, injunction proceedings are heard by the preliminary relief judge. The decision is provisional, but it can have immediate practical effect. The court may order a party to act, refrain from acting, provide information, stop unlawful conduct or, in certain cases, make a payment.
When are injunction proceedings relevant?
Injunction proceedings can be relevant in commercial, corporate and investment disputes where speed is essential. Examples include breach of contract, threatened termination, misuse of confidential information, enforcement of non-compete or non-solicitation obligations, shareholder or governance disputes, urgent M&A or post-closing disputes, and disputes involving Dutch companies, assets or counterparties.
For international clients, Dutch injunction proceedings may be important where a Dutch B.V., Dutch contract, Dutch asset or Dutch counterparty is involved. They can be used to obtain urgent relief in the Netherlands, create settlement pressure or prevent irreversible harm.
Strategic approach
The court will assess whether the matter is urgent, whether the claim is sufficiently plausible and whether the requested measure is appropriate in light of the parties’ interests. Because the procedure moves quickly, preparation is crucial.
A strong strategy requires a clear claim, a focused evidence file and a practical view on the desired outcome. In cross-border disputes, it is also important to consider jurisdiction, applicable law, enforcement and how the Dutch injunction fits into the broader international dispute strategy.
